A Nevada judge has invalidated the state’s Medicaid coverage limitations for abortion services, citing infringement of equal rights standards, in a historic ruling.
Clark County District Judge Erika Ballou’s ruling, announced from the bench on Tuesday, paves the way for expanded access to abortion care in the state.
Nevada’s Reproductive Health Milestone
Currently, Nevada’s Medicaid program only covers abortions in cases of life-threatening pregnancies or those resulting from rape or incest. Judge Ballou’s order would mandate Medicaid coverage for all abortions, significantly broadening reproductive health options for Nevadans.
The ruling comes amidst a backdrop of heightened legal and political battles nationwide over reproductive rights, particularly since the US Supreme Court’s decision to overturn Roe v. Wade and dismantle federal abortion protections.

Voters in Nevada ratified a thorough version of the Equal Rights Amendment in 2022, incorporating anti-sexism safeguards into the state constitution. The Equal Rights Amendment’s spirit is violated, according to ACLU attorneys, because Medicaid coverage restrictions on abortion disproportionately hurt underprivileged populations.
While the state attorney general’s office sought to dismiss the case on procedural grounds, Judge Ballou’s ruling underscores the importance of upholding reproductive rights and ensuring equitable access to healthcare for all Nevadans.
