Ivanka Trump’s attempt to delay her testimony in her father’s civil fraud trial was immediately dismissed by a higher court in a new legal development.
The decision comes shortly after she argued that appearing during a school week would cause her undue hardship.
Ivanka Trump’s Bid for Testimony Postponement
Ivanka Trump, who resides in Florida with her three minor children, sought to postpone her testimony until her appeal could be heard by the New York appellate court. Her attorney claimed that she would suffer undue hardship if she were required to testify in New York before her appeal, as she has already been dismissed from the case.
The motion for a stay, which aimed to halt the entire fraud trial against former President Donald Trump, his two adult sons, and his company, was denied in a filing on Thursday night.
Ivanka Trump’s brothers, Donald Trump Jr. and Eric Trump, both made appearances in court earlier on the same day, and the former President himself is expected to testify in the trial on Monday.

Dismissed as Co-Defendant
The New York Judge, Arthur Engoron, had previously ordered Ivanka Trump to testify in the trial, rejecting a motion from her attorney to quash a subpoena. In response, her attorney asked the appeals court to stay the ruling that required her testimony and to stay the trial itself.
Ivanka Trump’s attorney has argued that the New York civil court lacks jurisdiction to compel her testimony since she has not lived or worked in New York since 2017, and she is no longer a co-defendant in the case.
In June, a New York appeals court dismissed her as a co-defendant, citing that the claims against her were too old due to her exclusion from an August 2021 agreement between the New York Attorney General Letitia James’ office and the Trump Organization, which extended the statute of limitations.
The ongoing legal battle continues to draw attention, highlighting the complexities and legal intricacies surrounding the case.
