Iowa Governor Takes Action: Special Session Called to Reinstate Abortion Restrictions

By convening a special legislative session to explore further restrictions, Iowa Governor Kim Reynolds has made a major move in the ongoing conflict over abortion rights.

After the Texas Supreme Court decided not to overturn a 2018 ban on abortions beyond about six weeks of pregnancy, this action was taken.

Iowa’s Special Session to Deepen Abortion Restrictions

With the court deadlocked on the issue, the possibility of the GOP-controlled Legislature attempting to pass a similar ban has emerged. 

As the political landscape intensifies, lawmakers are set to convene on July 11 to address the contentious issue that continues to divide the state.

The blocked law in question sought to ban abortions once cardiac activity could be detected, usually around six weeks of pregnancy

However, medical experts argue that this activity does not signify an actual heartbeat but rather an initial flutter of electric movement within cells in an embryo. 

Democrats in the Legislature swiftly criticized the anticipated restrictions, highlighting the discrepancy between the expected measures and the preferences of the majority of Iowa residents. 

Polling data indicates that the majority of American adults, including Iowans, support at least some access to abortion, despite the fact that attitudes on the subject are diverse and few people support a complete ban on all cases of the procedure.

Governor Reynolds chose to call the special session after earlier attempts to enforce the 2018 ban were blocked by court rulings.

In contrast to last year, when Reynolds refrained from convening a special session and opted to pursue legal avenues, she now seeks legislative action.

Governor’s Call for Expedited Abortion

The governor’s order emphasizes the need for expeditious consideration of abortion-related matters, asserting that both Iowans and unborn children deserve government protection, as provided by the fetal heartbeat law.

While the court battles continue, uncertainty remains regarding the legal framework for abortion in Iowa.

The state Supreme Court has yet to determine whether earlier rulings applying the “undue burden test” for abortion laws still hold sway.

The undue burden standard demands that laws should not pose significant obstacles to abortion access.

However, the state argued that the law should be evaluated using rational basis review, the lowest level of scrutiny in assessing legal challenges.

The conflicting interpretations of constitutional standards add further complexity to the ongoing debate.

It is expected that any new abortion law passed during the special session will face legal challenges in state courts. 

Advocates on both sides of the issue are preparing to make their voices heard. Conservative Christian group The Family Leader has expressed its desire to see the Heartbeat bill reenacted, while the American Civil Liberties Union of Iowa strongly opposes the governor’s actions, emphasizing the importance of upholding the rule of law.
