Hunter Biden reportedly expects to utilize the Second Amendment as a defense if he is charged with a gun crime, according to White House press secretary Karine Jean-Pierre, who declined to respond to a question regarding his prior drug usage on Friday.
Jean-Pierre responded simply to the question of whether drug users should be permitted to own firearms during the White House press briefing: “I’m not going to go into a tit-for-tat on this. I’m just not going to.”
Legal Battle Over Hunter Biden’s Gun Charge
The Federal Department has been looking into Hunter, a known former drug user who struggled with drug misuse and addiction; part of this inquiry focuses on a 2018 firearms transaction. Hunter claimed he regularly used cocaine at the period.
A Supreme Court decision from last year that essentially expanded Second Amendment rights calls into question the federal law that forbids gun ownership by drug users, and Hunter’s attorneys may utilize this argument in support of their client’s case.
The SCOTUS ruling that Hunter Biden’s legal team is planning to utilize in his defense should he be accused, however, was previously denounced by Hunter’s father, President Biden, who expressed his “great disappointment” at the time.
In an official statement, Biden noted that since 1911, the State of New York has required those who want to carry a concealed handgun in public to demonstrate a need to do so for self-defense and to obtain a license.

Unlikely Allies in Challenging Second Amendment Precedent
The United States Supreme Court decided to invalidate New York’s long-standing right to defend its residents more than a century later.
Politico was the first to disclose that Biden’s attorneys have already informed DOJ officials that they intend to challenge the legislation on the grounds of the Second Amendment if their client is charged with a gun offense.
According to Politico in 2021, Biden filled out a federal form when he purchased the firearm in 2018, purportedly stating that he was not an unlawful user of, or addicted to, any restricted narcotic.
But according to Biden’s memoir from 2021, he used crack cocaine frequently at the time.
Hunter and conservative Republicans might support the same judicial precedent that is pro-Second Amendment in this circumstance.
