Airbnb Host Sued for Invasion of Privacy After Sending Guest’s Photo to His Wife

In a case that has garnered widespread attention, an Airbnb host, Pamela Fohler, is being sued by her guest, Shawn Mackey, for sharing a photo of him with another woman to his wife. 

This incident has led to a series of legal actions and a lawsuit that has been filed against both Airbnb and Ms. Fohler.

Airbnb Host’s Privacy Breach

Mr. Mackey, who had rented Ms. Fohler’s home in Memphis, Tennessee, for a football game in 2022, had planned to have four friends stay with him but wanted a space where he’d be able to bring additional guests if he wanted. 

He informed Ms. Fohler about his plans and requested her permission to have dinner at the property on one of the nights, with additional guests. 

The booking stated that the home could accommodate up to 12 people, and Ms. Fohler instructed Mr. Mackey on how to add his guests to the guest list.

However, shortly after Mr. Mackey’s arrival, Ms. Fohler allegedly demanded that he register the additional guests on the list or leave immediately, accusing him of violating the “no party” rule. 

Despite Mr. Mackey’s attempts to resolve the situation, Ms. Fohler eventually locked him out of the property and changed the locks, leading to Mr. Mackey being unable to access the property.

Legal Action for Sharing Guest’s Photo

After checking out of the property, Mr. Mackey left a negative review on Ms. Fohler’s Airbnb account and requested a refund. 

In response, Ms. Fohler allegedly harassed him about his negative review and had Airbnb remove it from the website. She also contacted Mr. Mackey’s wife with a photo of him with another woman, which has led to significant damage to his marriage and personal life.

The lawsuit filed by Mr. Mackey alleges that Ms. Fohler and Airbnb colluded in their actions, resulting in Mr. Mackey suffering humiliation, embarrassment, mental anguish, and monetary losses. The lawsuit seeks damages for the harm caused to Mr. Mackey’s reputation and personal life.

This case highlights the importance of respecting guests’ privacy and maintaining professionalism in the hospitality industry. It also serves as a reminder of the potential legal consequences of sharing personal information without consent.
