Attorney General Kris Kobach of Kansas has expressed concerns about school regulations that permit staff members to withhold a student’s gender identity from parents, claiming that these actions infringe upon the rights of parents.
Although Kansas does not have a legislation requiring parents to be informed about a student’s gender identification, Kobach contends that parents ought to be informed about important aspects of their child’s welfare.
Kansas Attorney General Challenges School Policies
Kobach’s statement follows his communication with six Kansas school districts last year, informing them that their policies regarding the concealment of transgender or gender-nonconforming status from parents were in violation of parental rights.
While two districts clarified their intent not to conceal students’ identities, four others purportedly defended their policies, asserting the authority of school administrators over parental involvement.
In response to Kobach’s inquiries, the districts have provided varying explanations. The Olathe school district clarified that it lacks a formal policy regarding transgender status disclosure, relying instead on internal administrative guidelines.
The district emphasizes its commitment to working directly with families to ensure appropriate support for students.
Superintendent Michelle Hubbard of the Shawnee Mission Unified School District issued a robust response to Kobach’s assertions, criticizing the lack of concrete examples demonstrating parental rights violations.
She condemned what she perceived as reliance on misinformation and emphasized the district’s dedication to serving its community.
Kobach’s scrutiny extends beyond individual districts, as he questions the involvement of organizations like the Kansas Association of School Boards (KASB) in drafting policies related to transgender student rights.
While KASB has affirmed its respect for parental rights, Kobach remains skeptical and asserts his commitment to holding entities accountable.

Parental Rights and Transgender Identity
Advocates for transgender rights, such as Justin Brace of Transgender Heartland, condemn Kobach’s stance as an attempt to erase the existence of transgender individuals in Kansas.
