Tragic Mishap: Teen Loses Legs in Trencher Blade Incident

A horrifying workplace incident in La Center, Washington, has left a 16-year-old boy with both legs amputated after being dragged underneath the blade of a walk-behind trencher. 

The Washington State Department of Labor & Industries (L&I) has conducted a safety investigation, leading to fines for the construction company involved and a broader examination of youth employment safety regulations.

Safety Violations Resulting in Severe Injuries

The teenager, participating in a 2023 work-based learning program, was using a walk-behind trencher on a job site in La Center to dig a channel for fence posts. Unfortunately, he was dragged beneath the blade, resulting in severe injuries that necessitated the amputation of both legs.

The work-based learning program, designed to provide students with real-world experience and academic credit, turned tragic when safety measures appeared to be inadequate. The incident highlights the importance of ensuring a safe working environment, especially for young participants in such programs.

Following a safety and health investigation, L&I has cited and fined Rotschy LLC, the Vancouver-based construction company that employed the teenager. 

The company is facing fines exceeding $150,000 for allegedly sending the minor to operate the machine without adequate supervision or safety measures.

Washington’s youth employment laws outline prohibited duties for workers under 18, and Rotschy LLC had a student learner exemption. However, the use of the walk-behind trencher was not covered by this exemption. 

L&I’s investigation identified violations of safety regulations, prompting fines and a reassessment of the company’s safety practices.

In response to the severity of the incident, L&I issued an order of immediate restraint to stop work and suspended the student learner exemption for Rotschy LLC. These measures aim to prevent further risks and ensure that the company addresses safety concerns promptly.

The Youth Employment Safety Unit is conducting a further investigation into Rotschy LLC’s practices, focusing on hiring requirements, prohibited duties, and the working hours permitted for young employees.

Rotschy LLC expressed deep sadness over the tragic incident and emphasized its commitment to safety. 

As a family-owned company with a previously strong safety record, the company acknowledged the distressing nature of the situation and pledged to learn from the incident, strengthening safety measures to prevent such tragedies in the future.

This heartbreaking incident underscores the need for heightened safety measures in workplaces, especially when young workers are involved. 

The fines and investigations serve as a means of accountability, urging employers to prioritize the safety and well-being of their workers, particularly those participating in educational programs.
