A US District Court Judge has ordered Texas to remove floating buoys deployed in the Rio Grande to deter migrants from illegally crossing the US-Mexican border.
This preliminary injunction represents a partial victory for President Joe Biden, who challenged the state’s actions in court.
Judge Orders Removal of Rio Grande Buoys, a Partial Win for Biden
Nonetheless, the decision has ignited a heated debate regarding border security and immigration policies.
The Buoys’ Relocation Deadline: US District Court Judge David Ezra issued the preliminary injunction in Austin, requiring Texas to move the buoys from their current location near Eagle Pass to a Texas riverbank by September 15th.
The Biden administration argued that the 1,000-foot barrier illegally impeded navigation and was erected without authorization from the US Army Corps of Engineers.
The ruling is a setback for Texas Governor Greg Abbott, a Republican who contends that President Biden has been too lax on border security, particularly in light of the record number of migrants captured illegally crossing the border in recent years.
Along the riverbank, razor wire coils have been installed as part of Governor Abbott’s efforts to discourage immigration.
In his 42-page order, Judge Ezra noted that Governor Abbott had stated he was not “asking for permission” for the border wall.
However, the magistrate emphasized that federal law requires authorization before the installation of obstructions in navigable waters.
Texas immediately appealed the verdict to the conservative-leaning 5th US Circuit Court of Appeals.
Governor Abbott’s office stated its willingness to take the case to the Supreme Court if necessary.
The governor’s office said, “Our battle to defend Texas’ sovereign authority to protect lives from the chaos caused by President Biden’s open border policies has only just begun.”
The US Department of Justice was pleased with Judge Ezra’s ruling, which emphasized the significance of adhering to federal statutes regarding waterways and navigational obstacles.
The Mexican government also released a statement emphasizing the importance of removing the buoys along the shared border and protecting the human rights of migrants.
Border Operations Controversy: In July, Governor Abbott’s border operations came under increased scrutiny following allegations that Texas authorities had been instructed to force migrant children back into the river and deny migrants water in extreme heat.

Tragedy and Diplomatic Tensions Surrounding Rio Grande Buoys
In addition, a tragic incident occurred when a deceased person was discovered entangled in the buoys, raising safety concerns regarding the barrier.
Navigational Dangers and Diplomatic Tensions: Judge Ezra, a Reagan appointee, emphasized the risks posed by the over 140 concrete anchors used to secure the buoys, which could cause significant harm to boats or vessels.
The Mexican government opposed the barrier, arguing that it violated a water pact between the two countries and could encroach on Mexican territory.
Judge Ezra acknowledged that the buoys had already compromised US-Mexico relations, emphasizing the importance of their removal.
