Former Trump attorney Timothy Parlatore expressed little surprise about the possibility of Trump not facing charges in Special Counsel Jack Smith’s investigation of his handling of classified documents.
Parlatore firmly stated that the assessment of each case should be grounded in factual evidence and relevant laws. He emphasized the importance of exercising discretion when determining the viability of a prosecution.
Departure from Trump Legal Team
During a recent appearance on Meet the Press with Chuck Todd, Parlatore expressed his views. Parlatore, who recently left Trump’s legal team due to internal matters, foresees further complications in the process of determining whether charges should be pursued.
For instance, if the case involves potentially sensitive national defense information, the issue of whether to declassify such information may impact the decision to bring charges. “Even if he did many of the alleged actions, prosecuting him might not be the most prudent decision due to these other obstacles,” Parlatore explained.
He emphasized that the classification of information does not bind the jury. It is necessary to present these documents to the jury and demonstrate that they constitute national defense information.

Parlatore’s Perspective on the Grand Jury Convening
Despite reports that a federal grand jury is convening this week to review evidence in the case, Parlatore indicated that this development does not necessarily alter his perspective on the likelihood of Trump facing charges.
“It could be that they are continuing an investigation into other matters. The break in proceedings may simply be due to the expiration of the previous grand jury, requiring the formation of a new one.
Parlatore expressed uncertainty regarding the details, stating that he has not been informed of any fresh information that would require further testimonies. He also finds it challenging to envision any additional individuals from Mar-a-Lago being summoned to provide testimony.
