Apple and Fintiv Engage in Negotiations for Potential Settlement of Patent Infringement Claims involving Apple Pay and Apple Wallet

A directive issued by the U.S. District Court for the Western District of Texas mandates Fintiv and Apple to engage in a settlement conference on June 8, 2023. 

Allegations of Patent Infringement Against Apple

This conference serves as the final step in the legal proceedings before the case proceeds to trial, although it is still possible for the parties to reach a settlement even if a trial commences.

Originally filed in December 2018, Fintiv’s patent infringement lawsuit was scheduled for a trial in 2022. However, the trial was postponed by the judge, and the discovery process was reopened.

The lawsuit alleges that Apple has both directly and indirectly infringed upon Fintiv’s patent related to technologies utilized in mobile wallet applications, specifically in its Apple Pay and Apple Wallet apps.

Accusations of Patent Infringement

Fintiv, initially established as Mozido, Inc. in 2010, is a financial technology company that offers a mobile cloud commerce platform, encompassing cloud payment services, loyalty programs, and marketing campaigns. The company holds several patents related to these technologies, both within the United States and internationally.

Over the past year, Apple has encountered various legal challenges due to accusations of patent infringement by other companies.

In February, the U.S. International Trade Commission (ITC) rendered a decision permitting the ban on Apple Watches’ imports to be suspended, citing Apple’s infringement of AliveCor’s patents for electrocardiogram (ECG) technologies in smartwatches.

The Biden administration chose not to intervene and halt the import ban, which remains on hold as the legal dispute between Apple and AliveCor continues through the appeals process within the ITC and the Patent and Trademark Office. Previously, the Patent and Trademark Office had deemed AliveCor’s patents invalid.

Additionally, the ITC is currently reviewing a potential import ban on Apple Watches based on allegations of Apple’s infringement of Masimo Corp.’s patents for pulse oximeter technology employed in smartwatches for measuring blood oxygen levels. In January, an initial ruling by the ITC favored Masimo, although the dispute process is still ongoing.
