Virginia teacher shot by 6-year-old student; School authorities sued for $40 million

Earlier this year, a 6-year-old pupil shot a first-grade teacher in Virginia, classroom. The teacher has since launched a lawsuit against the school’s leadership and the school board.

The complaint, which seeks $40 million in compensatory damages, was filed by teacher Abigail Zwerner, 25, whose parents allegedly declined to enroll their son in special education classes despite Richneck Elementary School personnel and officials being aware of the boy’s violent home life.

Virginia School Ignored Concerns

In addition, the lawsuit claims that the assistant principal of the school disregarded concerns and red flags raised by several teachers and staff members, including the possibility that the 6-year-old had a gun in his possession in the hours before the shooting on January 6 that left Zwerner hospitalized after a bullet passed through her hand and into her chest.

Parker allegedly said his pockets were too small to house a weapon and disregarded staff members’ worries after being informed by a school employee that the boy had removed the firearm from his bag and placed it in the pocket of his hoodie sweatshirt.

According to the complaint, a guidance counselor and primary school administrator claimed Parker allegedly forbade instructors from inspecting the 6-year-old for a gun, claiming his mother would be there soon to bring him up.

As per the lawsuit, Zwerner told Parker that the kid was in a hostile attitude the day of the shooting.

The 6-year-old was forced to be accompanied by a parent during the school day during the first half of the year due to his violent tendencies. But on that particular day, according to the complaint, school officials let him to spend the entire school day alone without a one-on-one companion.

Boy Won’t Face Criminal Charges

The boy’s family’s lawyer, James Ellenson, stated on Monday that the lawsuit’s accusations against the boy and his family should be treated with a grain of salt.

Howard Gwynn, the Commonwealth’s Attorney for Newport News, told CNN affiliate WTKR last month that the youngster would not face any criminal charges.

The lawsuit claims that the 6-year-old choked and strangled a kindergarten teacher during 2021–2022 and that the same year, he inappropriately touched a female classmate on the school playground by pulling up her dress.

The complaint claims that all defendants were aware that during the 2021–2022 academic year, the kid was transferred from the elementary school to Denbigh Early Childhood Center for showing violent behavior.
