A man in Texas has filed a lawsuit against three women, alleging that they assisted his ex-wife in obtaining abortion pills.
On March 9, Marcus Silva sued the ladies for more than $1 million, claiming that their claimed help in obtaining the abortion medication is equal to aiding murder under Texas law and that the women were therefore liable for his death.
Texas Man Sues Ex-Wife’s Friends
Ex-wife Silva is not named in the lawsuit, Silva is not pursuing any claims against her because she is immune from legal action as an abortion patient under Texas law, According to the complaint.
Silva claims his ex-wife realized she was pregnant in July of last year, just one month after Roe V. Wade was overturned and before Texas passed legislation making abortion a felony.
Silva says that two of the defendants communicated information from Aid Access, an international organization that ships abortion drugs by mail, with his ex-wife, while a third defendant arranged for the delivery of the medication. Text messages allegedly exchanged between the women are included as evidence in the complaint.
No charges have been filed against the women. Silva intends to sue the drug maker as well, according to the lawsuit, once the company is identified.
Silva is represented by Jonathan Mitchell, an attorney who participated in the development of a Texas law outlawing abortions beyond about six weeks of pregnancy, and Briscoe Cain, a Republican state representative.

Law Against Abortion
Since the overturning of Roe v. Wade, legal disputes over medication abortion have intensified in jurisdictions that prohibit the procedure. Walgreens just said that it will not sell the abortion medication mifepristone in 20 states that threatened legal action if they did.

This week, five women filed a lawsuit against the state for its restrictive abortion regulations, alleging that they were denied the operation even when their lives were in danger.
The case was brought by, President and CEO of the Center for Reproductive Rights, to halt the senseless agony, suffering, damage, and life-threatening complications caused by Texas’s abortion ban, according to Nancy Northup.
This is the first case of its kind. It is the first time that individual women have sued a state for the harm they sustained as a result of the criminalization of abortion therapy following the reversal of Roe v. Wade, Northup noted at a news conference held in front of the Texas State Capitol earlier this week.
